These Terms and Conditions are binding between any person or business (“The Client”) engaging or paying for services by The Curly Creator (“The Curly Creator” “We”).
The Curly Creator aims to provide our clients with the highest quality graphic design services including but not limited to brand creation, branding guidelines, printing solutions, social media assets and personal project designs. The specific deliverables The Curly Creator will provide per project will be decided upon between The Client and The Curly Creator within the preliminary stages/initial quote.
For each design project, initial concepts will be provided to The Client for review and selection. The Client may respond with their choice/s or specific changes required.
Correspondence between The Client and The Curly Creator with changes to be made may occur five times within the design process. Any further changes made after the initial five may incur further charges. Once changes have been made, The Client is required to provide written approval for the final design to be signed off.
All relevant files for final delivery of the job will be provided to The Client once final payment has been received by The Curly Creator. (See PAYMENT Terms and Conditions)
At The Curly Creator, The Client is the VIP in the creative process and highly valued. The Client’s needs are always our number one priority as we strive to provide a final design that The Client can be proud of. We want to work with The Client in partnership, making sure we get to the heart of their vision/business. In order for us to achieve this, we ask The Client to provide us with all the information we need as early on as possible as any delay in providing us with information can prolong the completion of the project. We also encourage The Client to provide feedback throughout the whole process, so that we can reach the desired outcome together as efficiently as possible.
All projects will need to be proofed by The Client including all design elements, copy, colours etc. The Curly Creator will always endeavour to have all information and design elements correct, however it is The Client’s full responsibility to ensure that all information is correct before providing written approval for the final design to be signed off. The Curly Creator takes no responsibility for any errors found after approval has been provided.
All changes and approvals by The Client must be provided in writing, either electronically or hard copy. Approval must be given by The Client in writing to The Curly Creator before any further progress can be taken with the project or before finalising the project.
The pricing is calculated based on an hourly rate and the scope of work that is required. The total price or costing elements will be set out in our quote and will be agreed upon before project commencement. Please note that the total project cost is subject to change due to the following circumstance:
- Additional design assets are required that were not initially agreed upon in initial quote
- Time spent on any stage of the project exceeds our initial estimate
- Client’s correspondence exceeding expected timeframes
- Additional assets purchased such as images or typeface/fonts
If the cost is anticipated to change, The Curly Creator will contact The Client immediately to inform and confirm the new amount.
The Client must agree to pay:
- 50% non-refundable deposit of the quoted amount to commence the project;
- 50% (or final amount of invoice) before final delivery of project assets; and
- any printing costs in full before files are provided to the printer for completion of a project.
The initial 50% deposit is non-refundable.
If The Client for any reason decides to cancel their project including because they had a change of mind, the deposit serves as a cancellation fee and will not be refunded. This is to cover any work that may have commenced already.
Once final payment has been received, The Client’s final files will be provided through a Google Drive link. The Curly Creator will provide various file formats that may including AI, EPS, PDF, PNG, JPEGs as well as any print ready files. If there are any specific requirements or files that must be prepared or provided please let The Curly Creator know at the beginning of the project.
Until the final payment has been received, The Curly Creator retains full ownership of each design. In the event of termination by The Client, The Curly Creator retains full ownership of the concepts and has the right to reuse, complete, exhibit or resell (not including the business name) all design concepts/elements.
It is agreed that once the final payment has been received, The Client has full ownership of their final designs and can use it in any materials or media useful for their business.
The Curly Creator reserves the right to use the final designs, or any versions created in the process, in any of our promotional materials or portfolios for our own business promotional use. The Curly Creator also reserves the right to use The Client’s business details for any testimonials or other business related materials.
The Client understands that The Curly Creator must be credited for all design work and this must be mentioned on all promotional or marketing materials, competitions or press releases. For example: Designed by The Curly Creator.
The Curly Creator will credit the assets of The Clients that we work with when using them in promotional material for
The Curly Creator.
